Glue On Toilet Seat Leads To Lawsuit Against Home Depot

November 15, 2005

A man has filed a lawsuit after being a victim of a prank at a Home Depot store. The man went to use the restroom when he became stuck to the seat after a prankster had put super glue on the toilet seat.

The lawsuit was filed against Home Depot because they ignored the pleas for help coming from Bob Dougherty, 57, because they thought he was joking.

The incident at the Louisville store occurred on the day before Halloween in 2003. At the time, Dougherty was recently recovering from a heart bypass surgery and the incident triggered him to think he was having another heart attack.

After employees heard him crying for help, they informed the manager, who dismissed it as a hoax.

A Home Depot spokeswoman was asked for a comment but said that she would not speak pending litigation.

According to the lawsuit, Dougherty was yelling for help for 15 minutes before the staff finally determined that it was real and called an ambulance. Rescue crews had to unbolt the toilet seat and wheel him out.

As he was being 'frightened and humiliated', he eventually passed out. According to the lawsuit, when he fell he suffered abrasions from where the toilet seat ripped off his skin.

Dougherty filed the lawsuit not to hold them accountable for the prank but for letting him repeatedly call for help with no answer.
